PROCESS SERVER INFORMATON

Process Server applicants are encouraged to read and become familiar with Administrative Order 20-34-B-Amd and §§ 48.25-48.31 , Florida Statutes.

Application

Each applicant, NEW or RENEWAL, must submit an Application to the Clerk of Court along with a non-refundable fee of $100.00.  This fee is payable to the Brevard County Clerk of Court by cash, check, money order, cashier’s check, debit card, or credit card (Visa, American Express, Discover, or Mastercard).  The application is available at the following link (Process Server Application) or at any Clerk of Court office locations. 

Background Check

Each applicant (NEW and RENEWALmust complete a live scan fingerprint background check by either a law enforcement agency or other live-scan vendor.  Complete the Background Information Sheet included in the Process Server Application packet and provide the completed form to the law enforcement agency or live-scan vendor.  The results will be sent to the Clerk of Court.  You must contact the law enforcement agency or live-scan vendor for day/time/location and cost information.  There will be a fee for the entity taking the prints as well as a fee to the Florida Department of Law Enforcement (FDLE).  Please note, after fingerprints are taken, the applicant may be required to an FDLE website (https://caps.fdle.state.fl.us) to pay FDLE’s fee and complete the request.

Bond

Each applicant, NEW or RENEWAL, must submit a $5,000.00 Surety Bond payable to the Eighteenth Judicial Circuit.  The effective date of the bond must cover the effective date of your appointment through the expiration of your appointment.

 

Educational Requirements

Each NEW applicant must successfully complete an orientation program in service of process.  The applicant shall file the course completion certificate with the Clerk of Court.  The orientation certificate expires one year after date of testing.  If an applicant does not activate the new process server certification within one year of testing, the applicant must retake the orientation program.

Each RENEWAL applicant must successfully complete an annual renewal program PRIOR to the expiration date of the order of appointment/reappointment.  If an applicant does not successfully complete an annual renewal program prior to the expiration date of the current order of appointment, the applicant must retake the orientation program AND begin the process as if a new applicant.

Process

Submit the following to the Clerk of Court in person at any Brevard Clerk of Court office location or by mail to:

  1. Completed and signed Application for Appointment as Process Server.
  2. Completed, signed, and notarized Acknowledgement page.
  3. $5,000.00 Surety Bond.
  4. Course Completion Certificate
  5. Non-refundable $100.00 fee payable by cash, check, money order, debit card, or credit card

Upon receipt of the above and the results of the background check, the Application will be referred to the Chief Judge for review.  Upon receipt of the Order of Appointment, you will receive a copy of the Order of Appointment and a new badge.  Please note that a new identification card will be issued each year upon renewal.  A new picture will be required every other year.  Please allow up to 6 weeks to process the Application.
