What is the Clerk’s role in the School Bus Safety Program?
The Brevard County Clerk of the Circuit Court & Comptroller (Clerk’s Office) processes uniform traffic citations after they are issued by law enforcement and filed with the Clerk’s Office. The Clerk’s Office does not issue the Notice of Violation or determine whether a school bus passing violation occurred.
Notice of Violation (NOV) – About:
If you received a Notice of Violation alleging that a vehicle registered to you illegally passed a stopped school bus, the notice was issued as part of the enforcement process authorized by Florida law.
School bus monitoring cameras may capture and document vehicles that pass a stopped school bus while its red flashing stop signal lights are activated. The recorded footage is provided to the Brevard County Sheriff’s Office (Sheriff’s Office) for review. If the Sheriff’s Office determines that a violation occurred, a Notice of Violation is mailed to the registered vehicle owner.
What should I do if I received a Notice of Violation?
Please follow the instructions provided on your Notice of Violation to address the alleged violation. The Notice of Violation will provide information regarding the available options and the applicable deadline.
The Clerk’s Office is not involved in the Notice of Violation process. Questions about the Notice of Violation, the alleged violation, or the recorded footage should be directed to the Sheriff’s Office or Brevard Public Schools.

How long does a violator have to address the offense as a Notice of Violation prior to the issuance of a uniform traffic citation?
In accordance with Florida Statute 316.173(9), a violator has 60 days from the issuance of a Notice of Violation to properly address the violation before law enforcement will issue a uniform traffic citation.
Uniform Traffic Citation Issuance – About and Frequently Asked Questions:
If you received a uniform traffic citation (UTC) alleging that a vehicle illegally passed a stopped school bus, the citation was issued by law enforcement pursuant to Florida law after the Notice of Violation process was not properly addressed within the applicable period. Once a UTC is issued and filed with the Clerk’s Office, the citation is processed in the same manner as other civil traffic citations.
- Make a Payment:
Payment must be made to the Clerk’s Office within 30 days of the date the citation was issued. - Request an Infraction Hearing:
Within 30 days of the date the citation was issued, the violator may request an infraction hearing before a county court judge to dispute the citation. - Filing Affidavit of Exemption with Law Enforcement:
Within 60 days after the date of issuance of the Notice of Violation or a uniform traffic citation, the violator can file an affidavit with the Brevard County Sheriff’s Office requesting an exemption under Florida Statute 316.173(10) if one is believed to be applicable.

A delinquency fee will be added to the citation case and a suspension against the violator’s driver license will be initiated. Additionally, unpaid citations are eligible for referral to a collection agency if they are 90 days delinquent. If referred to a collection agency, additional fees are assessed to the citation case.
